Is CBD legal?
Is CBD legal? Yes, in France, as long as a product contains less than 0.3% THC. This threshold marks the border between a wellness product and a narcotic. The European Court of Justice confirmed it with the Kanavape ruling: CBD is not a narcotic. Flowers and resins have been legal since the Council of State decision of December 2022. CBD e-liquids and cosmetics are also authorised. The only change: since 15 May 2026, CBD food products (ingestible oils, gummies, infusions) are banned from sale, under the European Novel Food regulation.
