Understanding CBD legislation in France
CBD is legal in France as long as it complies with a specific regulatory framework. CBD legislation is primarily based on one essential rule: any product must contain THC below 0.3%. This threshold clearly distinguishes cannabidiol from narcotic cannabis and allows the sale of flowers, resins, oils, infusions and other hemp-derived products. The CBD level may vary depending on the product and indicates its potential intensity, without affecting its legality as long as the THC limit is respected. However, it is not the sole indicator of quality, which also depends on the origin of the hemp and the manufacturing methods used. From a tax perspective, CBD VAT is currently under discussion. Some products have benefited from a reduced 5.5% VAT rate, while products intended to be smoked fall under the standard 20% VAT rate. A reform is considering a broader application of the 20% rate, but this measure is not yet final and must still be reviewed by a joint parliamentary committee and voted on by the National Assembly.
